Terms and conditions applicable to orders placed on ALFI-TURBO.COM

Article 1 — Preamble

These general terms and conditions of sale apply exclusively between the company ALFI-TURBO, 8 allée de la Flottière, 37300 Joué-lès-Tours (hereinafter ‘we’) and any person visiting or making a purchase via the website ALFI-TURBO.COM.

Any internet user may view these General Terms and Conditions of Sale on the website. As these terms and conditions are subject to change, the applicable terms and conditions are those in force on the website on the date the order is placed.

Article 2 — Contract

You dState your age d'be at least 18 years old and have legal capacity or be a holder of' d'a parental consent form allowing you to d'place an order on the website'.

Any order placed on the website must be in line with normal requirements d'a household'.

Once you have placed your order, we will send you an email confirming it. We would also like to inform you that your items have been dispatched.

Article 3 — Price, availability and delivery

The prices shown on the website are in euros, inclusive of all French taxes, excluding delivery charges, order processing fees and other charges d'gift wrapping'.

We can accept your orders subject to the availability of stock from our suppliers. Our products are made to order and fall into the ‘special order’ category. Product availability is shown on the page d'Information on each product'.

In the case of d'If payment is made by cheque, the order will only be processed upon receipt of the cheque, and the dThe applicable time limits shall be those in force on the date of receipt.

If, in dDespite our best efforts, the items are out of stock; we will notify you by email as soon as possible dDeadlines.

No compensation may be claimed if an item cannot be delivered as a result of d'an unexpected halt to production, failure to meet payment terms, or the absence of d'information required to fulfil the order or because' dA strike, dAn accident, dA fire, d'a natural disaster, d'an impossibility' d'supply issues or any other cause beyond our control'.

As part of d'In the case of a promotion offering free delivery, the cost of returning parts under the standard exchange scheme remains the customer’s responsibility'.

We recommend that you d'note any reservations on the delivery note if the parcel arrives' dHas been damaged, or if you are unable to check that its contents are in good condition.

In the event that d'unavailability in the dIf the items are out of stock, we reserve the right to offer a replacement item d'of high quality and d'equivalent prices'. In the event that d'If the item is permanently out of stock and no equivalent item can be supplied, the order will be cancelled'.

The deposit will not be refunded in the following cases, amongst others:

• Turbo broken by human hands and not as a result of d'mechanical breakage: sheared stud, cracked part, etc.'.
• Turbo dDismantled or with parts missing.
• Cracked cast iron.
• Damage caused by transport or inadequate protection/packaging.

Please note: If you do not return your deposit, the 24-month warranty will automatically be cancelled and reduced to 6 months in accordance with the provisions set out in our Terms and Conditions.

Article 4 — Customs duties

Any order placed on the website and delivered outside France may be subject to any applicable taxes and customs duties levied when the parcel reaches its destination.

Any such duties and taxes relating to delivery are payable by the customer and are the customer’s responsibility. We advise you to check with the relevant authorities in your country.

Article 5 — Payment

You can pay by credit or debit card or by cheque. Cards issued by banks based outside France must be international bank cards.

Payment by cheque is only possible if for cheques in euros drawn on a bank domiciled in France or Monaco.

Article 6 — Returns

In accordance with the provisions of Article L.Under Article 121-21 of the Consumer Code, you have the right to d'one' dA 14-day cooling-off period from the date of receipt of your goods for exercise your right of withdrawal without having to give a reason or pay a penalty.

Returns must be in their original condition d'Original and complete (packaging, accessories and instructions)'. Return delivery charges are payable by the customer.

In the event that dUpon exercise of the right of withdrawal, ALFI-TURBO will refund the sums paid within a dWithin 14 days of notification of your request, via the same payment method used when placing the order.

If the items have been dispatched, the postage costs will be dExcluded from the refund, plus a €10 restocking fee.

After the dOnce the withdrawal period has expired, no goods may be returned to us without our prior written consent and our return instructions.

6.1 — Return insurance in the event of d'error'

Return insurance provides cover in the event that d'reference error, to request a returns authorisation' for arranging for the return of your item. The request must be made by email or telephone within 48 hours of receiving the order.

This cover is excluded for the following countries: North America, Central America, South America, New Caledonia and Australia.

6.2 — Peace of Mind Package

We will replace or recondition your turbocharger in the event of a breakdown caused by an external factor, for a period of 2 years from the date d'purchase'.

A report d'A full report is being sent to you to help you identify the cause of the fault'. The customer is responsible for the cost of return postage. This package is registered to a specific person and cannot be transferred if the vehicle is sold.

The Serenity Package covers, in particular, damage relating to:

• A shock.
• The presence of metal filings caused by engine wear.
• A lower-quality oil.
• A poor-quality or clogged oil filter.
• An incident d'Arrival' d'oil'.
• Fitting the turbocharger without pre-filling the lubrication system.
• Inadequate oil and filter changes, or intervals that are too long.
• Dilution of the oil with fuel or glycol.
• A loss of the lubricant’s properties due to the rotor running at excessive speed, chip tuning or dDefects d'watertightness'.
• Shutting down the engine whilst it is still hot.
• Incorrect engine settings.

Exclusion: the turbine casing (exhaust section) as a whole.

6.3 — Return cover and Peace of Mind Package

Return insurance and the Peace of Mind Package are valid only for the product they are linked to at the time of ordering.

If several products are purchased in a single order and only one option is selected, that option will automatically be applied to the first product listed on the invoice. Other items will not be covered unless a specific option is added for each.

Article 7 — Retention of title

The goods delivered shall remain our property until they are dispatched, i.e. handed over to the carrier, once you have paid the price in full.

Article 8 — Warranties and Liability

You are covered by the provisions of the statutory guarantee against hidden defects.

All our products come with a 2-year warranty, excluding labour—d'the work'. Fees d'inspection or repair costs may be claimed'. During this period, we guarantee that our parts will function correctly, provided that normal conditions are observed d'the use and maintenance required to ensure the vehicle operates correctly'.

Work carried out under the warranty does not extend its duration beyond its original expiry date.

Since the 1st dDecember 2019, standard replacement turbochargers and the Cartridge come with a 2-year guarantee.

For warranty claims accepted, fitting costs and dDismantling is not covered by ALFI TURBO.

For after-sales service requests, if the assessment does not dShows no dOtherwise, the product will be returned to the customer once the results have been communicated. Fees d'Shipping costs are payable by the customer'.

If a product shows no faults, testing charges may be invoiced to the customer, including the flat-rate fee for the test bench test for turbos.

If the product has not been collected within two months of the customer being notified, it will be deemed to have been acquired by ALFI TURBO.

All parts and products must be fitted by a qualified automotive professional, in accordance with the car manufacturer’s standards and recommendations.

Any necessary supporting documents may be requested, in particular the invoice dDetailed assembly instructions. In the event of a warranty claim, this must be submitted to us within the dThe time limit set out in our terms and conditions.

Article 9 — Governing law and disputes

Any dispute relating to the interpretation and performance of these General Terms and Conditions of Sale shall be governed by French law.

To dIf an amicable settlement cannot be reached, the dispute will be brought before the Commercial Court of Tours (Article 48 of the Code of Civil Procedure).
